Terms of Use

These Terms of Use (“Terms”) govern access to babdar.com and related BabDar services. By creating an account or using BabDar, you agree to these Terms and our Privacy Policy.

1. Who we are

BabDar is an online marketplace that helps people discover homes for sale and rent in Morocco and connect with agents, landlords, and sellers. BabDar is not a brokerage, lender, or party to any real-estate transaction unless explicitly stated in writing.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for activity under your account and for keeping credentials confidential.

3. Listings and accuracy

• Users who publish listings must provide accurate, lawful information and have the right to list the property.
• Prices, availability, photos, and descriptions may change and can contain errors. Always verify with the listing party.
• BabDar may edit, refuse, or remove content that violates these Terms or applicable law.

4. Acceptable use

You agree not to:

• Scrape, spam, harvest emails, or abuse messaging/tour/lead features.
• Attempt unauthorized access, inject malicious code (XSS, SQL injection, etc.), or disrupt the service.
• Post fraudulent, discriminatory, illegal, or infringing content.
• Misrepresent your identity, affiliation, or authority to sell/rent a property.
• Use automated systems that overload or circumvent rate limits or security controls.

5. Inquiries, tours, and applications

When you contact an agent or submit a tour/application, your details may be shared with the relevant party so they can respond. BabDar does not guarantee responses, financing, or closing outcomes.

6. Third-party services & ads

BabDar may link to or promote third-party products (including Walletger). Those services have their own terms and privacy practices. BabDar is not responsible for third-party sites.

7. Intellectual property

BabDar branding, UI, and software are owned by BabDar or its licensors. You retain rights to content you upload, and grant BabDar a worldwide, non-exclusive license to host, display, and distribute that content to operate the marketplace.

8. Disclaimers

BabDar is provided “as is” and “as available.” We do not warrant uninterrupted service, error-free listings, or fitness for a particular purpose to the maximum extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, BabDar and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the service. Our aggregate liability for claims relating to BabDar shall not exceed the greater of (a) amounts you paid us in the 12 months before the claim, or (b) USD $100.

10. Indemnity

You agree to indemnify BabDar against claims arising from your content, listings, or misuse of the service, except to the extent caused by BabDar’s willful misconduct.

11. Termination

We may suspend or terminate access for violations of these Terms or for risk to users or the platform. You may stop using BabDar at any time and request account deletion via Contact.

12. Governing law

These Terms are governed by the laws of Morocco, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise.

13. Changes

We may update these Terms. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance.
